Los documentos de cesión de la propiedad de las tierras y las aguas (datas) al colonato repoblador para el cultivo cañero revelan que esta distribución se efectúo de acuerdo con la cultura jurídica vigente en los principales regadíos de la España peninsular. La producción azucarera, estimulada por la demanda exterior, creció a buen ritmo y formó una «sacarocracia » que pronto controló las instituciones hidráulicas y del poder local. Y como sin agua no había agroindustria, la «sacarocracia» se dedicó con ahínco a eliminar todo obstáculo que impidiera el ejercicio de la iniciativa privada en la capitalización del recurso hídrico. Asistimos entonces a la génesis de una cultura jurídica diferenciada de su patrón originario y propia de un sistema hidráulico caracterizado por la propiedad y gestión privada del agua.
